IF THE POLICE ARREST YOU…

– You may be handcuffed, searched,photographed and fingerprinted.
– Say repeatedly, “I DON’T WANT TO TALK UNTIL MY LAWYER IS PRESENT.” Even if
your rights are not read, refuse to talk until your lawyer/public defender arrives.
– Do not talk to inmates in jail about your case.
– If you’re on probation/parole tell your P.O. you
have been arrested, but NOTHING ELSE.
-If you’re undocumented, only talk to your lawyer
about your immigration status.

YOU HAVE THE RIGHT…

to be in a public space and observe police activity.
to remain silent.
to not be searched.
to calmly leave if you’re not detained or under arrest.
to a lawyer if you are arrested.
constitutional rights no matter your immigration or citizenship status.

REMEMBER

You have legal rights, but many police will not
respect your rights

Si la policía lo arresta…

-Puede ser esposado, esculcado, fotografiado
y sus huellas pueden ser tomadas.
-Repita, “No deseo hablar hasta que mi
abogado este presente.” Aún si sus derechos
no se han leído, no de mas que su nombre e
identificación hasta que llegue su abogado o
defensor publico.
-No hable con otras personas sobre su caso.
-Si esta en probación/parola dígale a su
oficial lo que ha sucedido solamente (que
está arrestado).
-Si es indocumentado, hable sobre su estatus
legal nada mas con su abogado y no le diga
nada a la policía.

SUS RESPONSABILIDADES Y DERECHOS

-Pregunte si está siendo detenido o arrestado
-Derecho de permanecer en silencio.
-Guarde la calma y sea
amable.
-No interfiera con la policía ni los obstruya.
-No mienta ni entregue documentos falsos.
-Recuerde y anote los detalles del incidente.
-Prepare una denuncia por escrito o llame a la ACLU u otros centros
de ayuda en su localidad si piensa que han violado sus derechos.
